Rental Terms & Conditions

Welcome to Emmenn Car Rentals (“we”, “our”, “us”).
These Rental Terms & Conditions apply to all vehicle rentals and bookings made through:

By booking or renting a vehicle from Emmenn Car Rentals, you agree to comply with the following terms.

1. Rental Agreement

When you rent a vehicle from Emmenn Car Rentals, you enter into a legally binding agreement governed by these Terms & Conditions and Australian consumer laws.

2. Driver Eligibility

To rent a vehicle, drivers must:

  • Be at least 21 years of age (unless otherwise agreed)
  • Hold a valid full driver’s licence
  • Present identification upon request
  • Meet insurance and safety requirements

Additional charges or restrictions may apply for young or inexperienced drivers.

3. Booking & Reservations

Bookings may be made online, by phone, or via an enquiry form.

A reservation is confirmed only when:

  • Availability is verified
  • Required documentation is provided
  • Deposit/payment is completed (if applicable)

We reserve the right to refuse bookings at our discretion.

4. Rental Period

The rental period begins at the agreed pickup time and ends when the vehicle is returned.

Late returns may result in additional charges, including:

  • Hourly extensions
  • Full-day rental fees
  • Penalties for unauthorised late drop-off

5. Vehicle Collection & Return

Vehicles may be collected and returned at agreed locations, including:

  • Seville Grove
  • Perth Airport (by arrangement)
  • Other Perth suburbs (subject to availability)

Customers must return the vehicle:

  • On time
  • With the same fuel level
  • In reasonable condition

6. Payment & Security Deposit

Rental charges may include:

  • Daily/weekly rental rate
  • Insurance coverage
  • Additional driver fees
  • Delivery or airport pickup charges
  • Fuel or cleaning fees (if applicable)

A refundable security deposit may be required, depending on the vehicle and rental type.

7. Use of Vehicle

The renter agrees:

  • To use the vehicle responsibly
  • Not to drive under the influence of alcohol or drugs
  • Not to use the vehicle for illegal purposes
  • Not to sub-rent or lend the vehicle without permission
  • Not to take the vehicle off-road unless approved
  • Not to exceed passenger or load limits

The vehicle must remain within approved travel areas unless otherwise agreed.

8. Fuel Policy

Unless stated otherwise:

  • Vehicles are provided with a full or agreed fuel level
  • Vehicles must be returned with the same fuel level

If returned with less fuel, refuelling charges may apply.

9. Insurance & Liability

Rental vehicles may include basic insurance options, subject to terms.

The renter may be liable for:

  • Excess charges in case of an accident
  • Damage caused by negligence
  • Theft due to an unsecured vehicle
  • Interior damage or misuse

Full insurance terms will be explained at the time of booking.

10. Breakdown & Roadside Assistance

If the vehicle breaks down or requires assistance:

  • Contact Emmenn Car Rentals immediately
  • Do not arrange repairs without authorisation

Roadside support may be provided depending on rental conditions.

11. Accidents & Damage

In the event of an accident:

  • Notify police (if required)
  • Contact Emmenn Car Rentals as soon as possible
  • Provide full incident details
  • Complete any required accident reports

Unauthorised repairs or failure to report may result in liability.

12. Traffic Fines & Violations

The renter is responsible for all:

  • Traffic fines
  • Parking violations
  • Toll charges
  • Speeding penalties

Incurred during the rental period.

Administrative fees may apply for processing fines.

13. Cancellations & Refund Policy

Cancellation policies may vary depending on booking type.

Generally:

  • Cancellations made 24–48 hours prior may qualify for a refund
  • Late cancellations or no-shows may result in partial or full charges

Please contact us as early as possible if plans change.

14. Cleaning & Smoking Policy

Vehicles must be returned in clean condition.

Additional cleaning fees may apply for:

  • Excessive dirt or stains
  • Pet hair
  • Food spills
  • Smoking inside the vehicle (strictly prohibited)

15. Termination of Rental

We reserve the right to terminate the rental agreement immediately if:

  • Terms are breached
  • The vehicle is misused
  • False information is provided
  • Payment obligations are not met

The vehicle must be returned immediately upon termination.

16. Limitation of Liability

To the maximum extent permitted by law, Emmenn Car Rentals is not liable for:

  • Loss of personal belongings
  • Delays caused by weather, road conditions, or third parties
  • Indirect or consequential damages

Nothing in these Terms excludes rights under Australian Consumer Law.

17. Privacy

Personal information collected during booking is handled according to our Privacy Policy:

18. Changes to Terms

We may update these Terms & Conditions at any time.
